Terms of Service

Last updated October 20, 2026

These Terms of Service (the "Terms") are a binding agreement between you and Travis Glover ("Acorn Pages", "we", "us" or "our"). They govern your use of the websites, newsletter tools, hosting and related services we offer at acornpages.com and scheduleaid.com and their subdomains, and through any site we host for you (together, the "Service"). By creating an account, ticking the box at sign-up, or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Please read these Terms carefully. Section 12 contains an arbitration agreement and class action waiver: with limited exceptions, disputes between us are resolved by binding individual arbitration, not in court, and not as part of a class or representative action. Section 12 also tells you how to opt out within 30 days. Sections 9 and 10 limit our liability to you and disclaim warranties.

1. Who may use the Service

You must be at least 18 years old and able to form a binding contract. The Service is offered to businesses, professionals and other organisations for their own commercial or professional use. If you use the Service for a business or organisation, you represent that you have authority to bind it, and "you" means both you and it. You agree to give accurate, complete and current information at sign-up and to keep it so, including the email address we use to reach you.

You are responsible for everything done through your account, by you or by anyone you let use it. Keep your password confidential and tell us at once at glovertravis@gmail.com if you believe your account has been accessed without your permission.

2. Subscriptions, fees and automatic renewal

Plans and prices. The Service is sold by subscription. The price of each plan and add-on is shown when you sign up and on our sign-up pages, in US dollars, exclusive of taxes. You are responsible for any sales, use, VAT or similar taxes that apply, which we may add to your bill.

Free trial. A new site starts with a free trial of 30 days (or the longer trial shown when you sign up through a referral). We take a payment card when the trial starts and charge it when the trial ends, unless you cancel before then. One trial per customer; we may refuse, shorten or end a trial at our discretion.

Automatic renewal. Your subscription renews automatically at the end of each billing period (monthly or yearly, as you chose) until you cancel. You authorise us, through our payment processor Stripe, to charge the payment method on file for each renewal, for add-ons you turn on, and for any taxes due. Add-ons are prorated when turned on or off mid-period.

Price changes. We may change the price of any plan or add-on at any time. If a change affects your current subscription, we will email the address on your account at least 30 days before it applies to you, and the new price takes effect at your first renewal on or after the end of that notice period. If you do not accept the new price, cancel your subscription before that renewal; keeping your subscription after that date means you accept it.

Cancelling. You may cancel at any time from the Billing page in your site's settings. Cancellation takes effect at the end of your current billing period: your site stays online until then, and you are not charged again. All fees are non-refundable. We do not give refunds or credits for partial periods, unused time, downgrades, or any other reason, except as required by law or as stated in Section 3.

Failed payments. If a payment fails, we and Stripe may retry it. If it still fails we may suspend your site or end your subscription. We may charge a reasonable fee to restore a site suspended for non-payment.

Referral credits. Credits earned through our referral programme have no cash value, are applied only against your own bill, may be changed or withdrawn at any time, and are forfeited when your subscription ends.

3. Suspension and termination

You may end this agreement at any time by cancelling your subscription as described above.

We may suspend or terminate your account, your site, or any part of the Service at any time, with or without cause, with notice to the email address on your account where practicable. We may do so immediately and without notice if you breach these Terms, if your site or newsletters create legal, security, deliverability or reputational risk for us, if a payment is overdue, or if the law or a third party requires it. If we terminate your subscription without cause, we will refund the prepaid fees for the unused part of your current billing period, which is your only remedy for such a termination.

When your subscription ends for any reason, your site and newsletters go offline. You can download everything on your site - its pages, pictures, subscriber list, newsletters and messages - from its settings at any time, including for 30 days after your subscription ends. We may delete your content at any time from 30 days after your subscription ends, and we have no obligation to keep or return it after that. Sections 4, 9, 10, 11, 12 and 13 survive termination.

4. Your site, your content and your customers

Your content. You own the text, pictures, files, subscriber lists and other material you put into the Service ("Your Content"). So that we can provide the Service, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, display, back up and make technical adaptations of Your Content (such as resized images, PDF exports and newsletter renderings), and to pass it to our service providers for the same purposes. This licence lasts while Your Content is on the Service, and for backups until they are deleted in the ordinary course.

You represent and warrant that you own or have the rights needed for Your Content and for every email address you add, that Your Content and your use of the Service comply with all applicable laws, and that Your Content does not infringe anyone's rights or contain anything unlawful, defamatory, deceptive or harmful. We may remove or refuse any content, or take any site offline, at our sole discretion and without liability to you.

Your customers are yours. Your visitors, clients, patients, subscribers, guests and customers are yours, not ours. You alone are responsible for your dealings with them, including any professional services you offer, any rentals you list and any bookings you take, any payments you collect, and the notices, policies, licences, disclosures and consents your business or profession requires. We are not a party to any transaction or relationship between you and them, and we give no professional, legal, medical, financial or tax advice. Where the Service lets your guests or customers pay you online, the payment is made to your own Stripe account under Stripe's terms: you are the merchant, refunds, chargebacks, disputes and taxes are yours, and we keep the platform fee shown when you connect your account.

Newsletters and email. You are the sender of every newsletter and email sent from your site, and you are responsible for them under the CAN-SPAM Act and every other law that applies. You warrant that each recipient gave you permission to email them; you will not add purchased, rented, scraped or otherwise unconsented addresses. Every newsletter carries an unsubscribe link, which you must not remove or circumvent. We may set and change limits on subscribers and on sending, and we may delay, pause or stop your sending at any time, including when bounces or complaints reach levels that threaten our sending reputation, without liability to you.

Domains. A domain you connect to your site remains yours: you are responsible for registering and renewing it, for its DNS, and for your right to use it. We may stop serving a domain that is not pointed at us or that creates risk for us.

Limits and backups. We may set and change limits on storage, uploads, subscribers, sending and requests. We make backups for our own operational needs; they are not a service to you, and you should keep your own copies of anything you cannot afford to lose.

5. Acceptable use

You will not use the Service to: break any law or anyone's rights; send unsolicited bulk email, phishing messages or malware; publish content that is sexually explicit, that exploits or endangers children, or that harasses, threatens or incites violence against anyone; impersonate anyone or misrepresent your affiliation; collect personal information unlawfully; probe, scan or test the Service's security or interfere with its operation; circumvent its limits or access controls; scrape or copy the Service or other customers' sites; resell or sublicense the Service; or use it for any purpose that is high-risk, fraudulent or deceptive. We may investigate suspected violations and cooperate with law enforcement.

6. Privacy and your visitors' data

Our Privacy Policy explains how we handle information about you. For the personal information of your visitors, subscribers, guests and customers that you collect through your site, you are the controller (or "business") and we process it only on your behalf and on your instructions, to provide the Service. You are responsible for having a lawful basis for collecting it, for your own privacy notice, and for honouring their requests. We will help you meet those obligations where the law requires it, at your reasonable cost. The Service is hosted in the United States and is not designed for information that is subject to special regulation, such as protected health information under HIPAA or payment card data: do not collect such information through it, and you agree that we are not your business associate.

7. Third-party services

The Service relies on third parties, including Stripe (payments), Amazon Web Services (hosting, storage and email delivery), Google (reCAPTCHA and maps) and domain registrars. Their terms and privacy policies apply to their services, and we are not responsible for them. Payments are subject to Stripe's terms.

8. Our property and changes to the Service

The Service, its software, designs, starter pages, templates, documentation and trademarks are owned by us or our licensors and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to use them as part of the Service while your subscription lasts. You will not copy, modify, reverse engineer, scrape or build a competing product from any part of the Service. If you send us feedback or suggestions, we may use them freely without obligation to you.

We may change, add or remove features of the Service at any time. We will try to give notice of changes that materially reduce what you can do, but we have no obligation to maintain any feature.

9. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error-free; that any email will be delivered; that any data will not be lost; that your site will achieve any search ranking, traffic, bookings or revenue; or that the Service meets your requirements. You use the Service at your own risk.

10. Limitation of liability

To the fullest extent permitted by law: (a) we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill or data, or the cost of substitute services, arising out of or relating to these Terms or the Service, however caused and under any theory of liability, even if we were told such damages were possible; and (b) our total liability for all claims arising out of or relating to these Terms or the Service will not exceed the greater of the fees you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars ($100).

These limits apply together and to every claim, whether in contract, tort (including negligence), strict liability or otherwise. They do not limit liability that cannot be limited by law, including for fraud, wilful misconduct, or death or personal injury caused by negligence where such a limit is not allowed. You agree that our fees reflect this allocation of risk and that we would not offer the Service without it. Where a jurisdiction does not allow some of these limits, they apply to the fullest extent it does allow.

11. Indemnification

You will defend, indemnify and hold harmless us (Travis Glover) and our owners, affiliates, officers, employees, contractors and agents from and against all claims, demands, losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or relating to: Your Content; your site, newsletters and emails; your products, services, rentals, bookings and dealings with your visitors, clients, guests, subscribers and customers; your breach of these Terms; your violation of any law or of anyone's rights; or use of the Service through your account. We may take over the defence of any matter subject to indemnification, at your expense, and you will cooperate with us. You will not settle any such matter in a way that admits fault or imposes obligations on us without our written consent.

12. Dispute resolution: arbitration agreement and class action waiver

Talk to us first. Before starting any formal proceeding, the party with a claim will send the other a written description of it (to us, at glovertravis@gmail.com; to you, at the email address on your account) and the parties will try in good faith to resolve it for 60 days. A claim that is not resolved in that time may be brought as set out below.

Binding arbitration. Except as set out in this Section, any dispute, claim or controversy arising out of or relating to these Terms or the Service, including their formation, interpretation, breach, termination, validity and enforceability, and the scope and enforceability of this agreement to arbitrate (a "Dispute"), will be resolved by final and binding arbitration before a single arbitrator administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules, or its Consumer Arbitration Rules where the AAA determines they apply. The arbitrator, not any court, decides all Disputes, including whether a Dispute is arbitrable, except that a court decides the enforceability of the class action waiver below. The arbitration will be held by video conference, telephone or written submissions, or, if an in-person hearing is required, in California. The arbitrator may award the same relief a court could, to the party seeking it as an individual only. Judgment on the award may be entered in any court with jurisdiction. Each party bears its own attorneys' fees and costs, unless the arbitrator finds a claim or defence frivolous or brought for an improper purpose and the law allows an award of fees. The Federal Arbitration Act governs this Section.

Class action and jury trial waiver. You and we agree that each may bring claims against the other only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding. To the fullest extent permitted by law, you and we each waive the right to a trial by jury in any proceeding between us.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek an injunction or other equitable relief from a court to protect its intellectual property or to stop unauthorised use of the Service.

Opting out. You may opt out of this agreement to arbitrate by emailing glovertravis@gmail.com within 30 days after you first accept these Terms, with your name and your site's address and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

If the waiver is unenforceable. If the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and brought in court, and the rest of the Dispute will be arbitrated; any such court proceeding will be stayed pending the arbitration.

Governing law and venue. These Terms and any Dispute are governed by the laws of the State of California and the Federal Arbitration Act, without regard to conflict-of-law rules. For any matter that may be brought in court under this Section, you and we consent to the exclusive jurisdiction of, and venue in, the state and federal courts located in California.

Time limit. To the extent permitted by law, any claim arising out of or relating to these Terms or the Service must be brought within one year after it arises, or it is permanently barred.

13. Changes to these Terms

We may change these Terms from time to time. For changes that materially affect your rights, we will email the address on your account, or show a notice in the Service, at least 30 days before they take effect; other changes take effect when we post them, with the "Last updated" date above. Continuing to use the Service after a change takes effect means you accept it. If you do not agree, cancel your subscription before then. Changes to Section 12 do not apply to a Dispute of which either party gave the other notice before the change took effect.

14. General

Notices. We may give you notice by email to the address on your account or by a notice in the Service, effective when sent or shown; keep your email address current. Notices to us go to glovertravis@gmail.com. You consent to receive communications from us electronically.

Entire agreement; severability; waiver. These Terms and the Privacy Policy are the entire agreement between you and us about the Service and replace any earlier agreement. If any part of these Terms is held unenforceable, it will be enforced to the extent permitted and the rest remains in effect (subject to Section 12's own rule). Our failure to enforce any part of these Terms is not a waiver of it.

Assignment. We may assign these Terms, in whole or in part, without your consent, including to a successor to our business. You may not assign or transfer them, or your account, without our written consent; any attempt to do so is void.

Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including failures of our service providers, networks or power, strikes, fire, flood, epidemics, acts of government, war or civil disturbance.

Relationship; no third-party beneficiaries. You and we are independent contractors. Except for the persons indemnified in Section 11, no one else has any rights under these Terms.

Export and location. The Service is operated from the United States. We make no representation that it is appropriate elsewhere, and you are responsible for complying with local law where you use it.

Copyright complaints. If you believe content on the Service infringes your copyright, send a notice meeting the requirements of the Digital Millennium Copyright Act to glovertravis@gmail.com. We may remove the content and terminate repeat infringers.

California residents. Under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
